Sec. 2. Section thirty-one of Act numbered Seventeen hundred

and sixty-one, as amended by section three of Act numbered Nine-

-teen hundred and ten, is hereby further amended to read as follows:

"Sec. 31. Any unauthorised person owning, carrying, holding,

having, controlling, having possession of, or knowingly having on

his premises, any opium, cocaine, alpha or beta sucaine, or any

derivative or preparation of such drugs or substances, on and

after March first, nineteen hundred and sight, shall be punished

by a fine not exceeding ten thousand pesos, nor less than three

hundred pesos, or by imprisonment for not exceeding five years, nor

less than three months, or by both such fins and imprisonment, in

the discretion of the court: Provided, however, That any un-

-authorised dealer in opium, cocaine, alpha or beta sucaine, or

any derivative or preparation of such drugs or substances, shall be punished by imprisonment for not less than six months nor more

than five years, with or without fine. Any unauthorised person making one or more sales of opium, cocaine, alpha or beta sucaine, or any derivative or preparation of such drugs or substances, in any quantity, or owning, carrying, holding, having, controlling, having possession of, or knowingly having on his premises, any

opium, cocaine, alpha or beta eucaine, or any derivative or prepara-

-tion of such drugs or substances, in any quantity exceeding one hundred grams, shall be regarded as a dealer in opium: And provided further. That in the case of the commission of a second offence

under the provisions of this section, any person so convicted, if other than a citizen of the United States or a citizen of the

Philippine Islands, may, by order of the Court, be deported".
